TERMS OF SERVICE

1. Introduction
Welcome to Deco Apps (“Deco”, “we”, “our”, or “us”). These Terms of Service govern your access to and use of our platform, services, and network connecting independent appraisers and adjusters with clients across North America. By accessing or using our services, you agree to comply with and be bound by these Terms. If you do not agree, you must not use the platform. These Terms apply to all users, including applicants, approved members, and visitors.

2. Eligibility
To use Deco’s services, you must be legally capable of entering into a binding agreement and operate a legitimate appraisal or adjusting business. Users are required to provide accurate, complete, and up-to-date information during the application and onboarding process. Deco reserves the right to approve, reject, or revoke membership at its sole discretion. You are responsible for maintaining the confidentiality of your account information and for all activities under your account.

3. Services Overview
Deco provides a technology-driven platform that connects independent appraisers and adjusters with claim opportunities across various industries, including automotive, heavy equipment, powersports, agriculture, and more. Our services include claim management tools, business support resources, and access to a professional network. Deco does not directly perform appraisals but facilitates connections and workflows between members and clients.

4. Account Access and Approval
Certain features of the platform may require registration or approval. Deco reserves the right to approve or deny access at its discretion. You are responsible for maintaining the confidentiality of your account and for all activities conducted under it.

5. Services Provided
Deco provides a platform that connects independent appraisers and adjusters with claim opportunities across various personal property sectors, including automotive, heavy equipment, powersports, agriculture, trailers, and recreational vehicles.

The platform enables users to access claim-related opportunities, utilize tools, and engage with a professional network. Deco does not directly perform appraisal or adjustment services but facilitates connections between professionals and clients.

While Deco aims to support business growth and provide access to opportunities, it does not guarantee the availability of assignments or a minimum volume of work.

6. Member Responsibilities
Users are responsible for maintaining professionalism, accuracy, and compliance with all applicable laws, regulations, and licensing requirements. Any services performed through connections made via Deco are the sole responsibility of the user providing those services.

7. Intellectual Property
All content, trademarks, logos, and materials available on the Deco platform are the property of Deco Apps or its licensors. You are granted a limited, non-exclusive, non-transferable right to access and use the platform for its intended purpose. Unauthorized use, reproduction, or distribution is strictly prohibited.

8. Confidentiality
Users may have access to sensitive or confidential information related to clients or claims. You agree to protect such information and use it only for legitimate business purposes. Unauthorized disclosure or misuse is strictly prohibited.

9. Limitation of Liability
Deco acts solely as a platform connecting professionals and clients. We do not guarantee the availability of opportunities, the accuracy of information, or the outcomes of services provided by users. To the fullest extent permitted by law, Deco is not liable for any indirect, incidental, or consequential damages arising from use of the platform.

10. Termination and Suspension
Deco reserves the right to suspend or terminate access to the platform at any time for violation of these Terms or for any other reason deemed necessary. Users may stop using the platform at any time.

11. Changes to These Terms
We may update these Terms of Service from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law
These Terms shall be governed by and interpreted in accordance with the applicable laws of the jurisdiction in which Deco operates, without regard to conflict of law principles.

13. Google User Data 

Deco may allow authorized users to connect their Google account to Deco for the purpose of sending, receiving, reading, and managing email communications within the Deco platform. 

When a user or tenant authorizes Deco to access a Google account, Deco may access, collect, process, and store Google user data only as necessary to provide the email integration features requested by the user or tenant. 

14. Google User Data Accessed 

Depending on the permissions granted by the user and the features enabled in Deco, Deco may access and process the following Google user data: 

  • Email address and basic account information associated with the connected Google account. 
  • Email message metadata, including sender, recipient, To, CC, BCC, subject, date/time, and message identifiers. 
  • Email message content, including the message body. 
  • Email attachments, where applicable and only when required for the email-related functionality used within Deco. 
  • OAuth access tokens and refresh tokens required to maintain the authorized connection between Deco and the connected Google account. 

15. How Deco Uses Google User Data 

Deco uses Google user data only to provide and support user-facing email functionality within the Deco platform. This includes: 

  • Connecting a user’s or tenant’s Google email account to Deco. 
  • Sending emails from Deco using the authorized Google account. 
  • Receiving and reading emails from the authorized Google account. 
  • Displaying email communications inside Deco. 
  • Associating email communications with relevant Deco records, including appraisals, claims, tenants, users, customers, files, or related business records. 
  • Storing email history and related email details so authorized Deco users can review communication history within the application. 
  • Maintaining the email integration through OAuth authentication. 
  • Troubleshooting, securing, and supporting the email integration. 

Deco does not use Google user data for advertising, retargeting, personalized advertising, credit-worthiness determinations, lending purposes, or any unrelated purpose. 

16. Google User Data Stored by Deco 

Deco may store email-related data that is required to provide the email integration and communication history features. This may include: 

  • Email subject. 
  • To, CC, and BCC recipients. 
  • Sender information. 
  • Message ID or other email identifiers. 
  • Email message body. 
  • Related metadata required to connect the email communication to Deco records. 
  • OAuth tokens required to maintain the authorized Google connection. 

OAuth tokens are used only to authenticate with Google APIs for the authorized email integration. Deco takes reasonable measures to protect Google user data, including protecting data in transit and at rest. 

17. Sharing of Google User Data 

Deco does not sell Google user data. 

Deco does not share Google user data with advertising platforms, data brokers, information resellers, or third parties for marketing, advertising, retargeting, or unrelated purposes. 

Deco may share or disclose Google user data only in the following limited circumstances: 

  • To provide or improve the user-facing email features requested by the user or tenant. 
  • To authorized users within the same tenant or organization, where required for the business workflow within Deco. 
  • To service providers who support Deco’s hosting, storage, security, monitoring, or application operations, and only as necessary for them to provide those services. 
  • To investigate security issues, prevent abuse, or troubleshoot the application. 
  • To comply with applicable laws, legal obligations, or valid legal requests. 
  • As part of a merger, acquisition, or sale of assets, where permitted by law and subject to appropriate notice or consent where required. 

18. Human Access to Google User Data 

Deco personnel do not access Google email content unless access is necessary for security, support, troubleshooting, legal compliance, or where the user or tenant has requested support related to specific email data. 

19. Data Retention and Deletion 

Deco retains Google user data only for as long as necessary to provide the email integration, maintain communication history, comply with legal obligations, resolve disputes, enforce agreements, or support tenant business requirements. 

Users or tenants may disconnect the Google integration. When the integration is disconnected, Deco will stop using OAuth tokens to access the Google account. Stored email records may remain in Deco where they are part of tenant communication history, business records, audit records, or legal/compliance records, unless deletion is requested and deletion is permitted under applicable law and contractual obligations. 

20. Compliance with Google API Services User Data Policy 

Deco’s use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. 

Deco uses Google user data only to provide or improve user-facing features that are prominent in the Deco application. Deco does not transfer, sell, or use Google user data for advertising, retargeting, personalized advertising, data brokerage, information resale, credit-worthiness, or lending purposes. 

Deco requests access only to the Google permissions required to provide the email integration features used by the user or tenant.
